Living Wills or Advance Medical Directives in Northern Virginia

From Attorney Northern Virginia Trusts & Estates

None of us like to think of a time when we may become incapacitated through ill-health or an accident, but it is wise to plan for even the most unforeseen circumstances to protect yourself, your assets and estate, and your family.

An advance health care directive (sometimes referred to as a living will or an advanced medical directive) will ensure that your instructions are followed for your treatment in Northern Virginia. It also ensures that a power of attorney is granted to someone of your choice to make decisions on your behalf.

What is a living will or advance medical directive?

A living will or advance medical directive (also known as an advanced medical directive) gives instructions on your treatment in the event of serious ill-health or a major accident. Creating a living will means that you can make decisions about your healthcare while you are able to make such decisions. This will free your family from the pressures of the dilemmas faced when no such instructions are in place, at a time when undoubtedly there is enough trauma to cope with.

Your wishes as to what to do in the event of such an emergency, can be specific or general, and can include:

  • Life support

  • Resuscitation (including DNR Do Not Resuscitate instructions in specific instances)

  • Analgesia and pain management

  • Feeding

  • Antibiotics

  • Transfusions

A living will or advance medical directive, can also include a durable power of attorney or health care proxy, who can make legal decisions for you whilst incapacitated.

Why you should make a living will?

While none of us want to think of a day when we are incapable of communicating our wishes, it is far better to plan ahead to ensure that you receive the treatment that you choose, rather than leaving the burden of decision making on your family or the health care team.
